Terms of Service
These terms govern access to Hospelo’s website, early-access scheduling service, and restaurant workforce messaging program.
Effective July 24, 20261. Agreement to these terms
By accessing or using Hospelo, you agree to these Terms of Service and our Privacy Policy. If you use Hospelo for a restaurant or other organization, you represent that you are authorized to accept these terms on its behalf.
2. The Hospelo service
Hospelo helps restaurant teams collect availability, generate draft schedules, communicate published shifts, coordinate coverage, process scheduling requests, and review workforce information. Features may change during early access as the service is tested and improved.
3. Restaurant responsibilities
Restaurants are responsible for the accuracy of employee, availability, scheduling, pay, policy, and contact information they provide. Restaurants must review schedules and automated recommendations before relying on them, configure appropriate approval rules, obtain required employee consent, and comply with employment, wage-and-hour, privacy, and communication laws.
Hospelo is an operational tool and does not provide legal, payroll, tax, employment, or human-resources advice.
4. Accounts and access
Users must provide accurate information, protect login methods and verification codes, and promptly notify Hospelo of unauthorized access. Users may access only the restaurant, employee, and scheduling information they are authorized to use.
5. SMS messaging terms
Program name: Hospelo Restaurant Operations Messaging
With voluntary consent, users may receive recurring operational SMS or MMS messages about schedules, schedule changes, time-off requests, callouts, open shifts, coverage decisions, manager alerts, and occasional hours-preference check-ins.
- Message frequency varies based on restaurant activity.
- Message and data rates may apply.
- Consent to receive texts is not a condition of employment or purchase.
- Reply STOP to unsubscribe. A confirmation message may follow.
- Reply HELP for help, or email support@hospelo.com.
- Carriers are not liable for delayed or undelivered messages.
Users who change or transfer a phone number should promptly update their restaurant or Hospelo. Opting out of SMS does not cancel an account; the restaurant must provide an available alternative for required workplace communications.
6. Acceptable use
You may not misuse Hospelo, attempt unauthorized access, interfere with the service, send unlawful or deceptive messages, upload malicious material, impersonate others, use employee data outside legitimate restaurant operations, or use the service in violation of applicable law or carrier requirements.
7. Early access and availability
Early-access features may contain errors, change without notice, or be temporarily unavailable. We work to provide a reliable service but do not guarantee uninterrupted operation, delivery of every message, or that an automated recommendation will address every restaurant policy or scheduling constraint.
8. Intellectual property
Hospelo and its software, branding, design, and service materials are owned by Hospelo or its licensors. Restaurants retain their rights in the information they provide and grant Hospelo permission to process that information only as needed to provide, secure, and improve the service.
9. Third-party services
Hospelo may rely on third parties for hosting, authentication, communications, analytics, and other functions. Those services may be governed by their own terms, and Hospelo is not responsible for carrier outages or failures outside its reasonable control.
10. Disclaimers and limits
To the extent permitted by law, Hospelo is provided “as is” and “as available” without warranties of uninterrupted or error-free operation. To the extent permitted by law, Hospelo will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service.
11. Suspension and termination
Hospelo may restrict or terminate access when reasonably necessary to protect users, comply with law, prevent abuse, address nonpayment, or enforce these terms. A restaurant may stop using the service, subject to any applicable service agreement.
12. Changes and contact
We may update these terms as Hospelo develops. The updated terms will be posted here with a new effective date. Questions may be sent to support@hospelo.com.
